Vermont latest state to sue PBMs for allegedly driving up drug prices

July 17 (Reuters) -Vermont's attorney general on Wednesday sued two of the largest U.S. pharmacy benefit managers, accusing them of driving up prescription drug prices for patients in order to enrich themselves, joining other states that have brought similar claims against the drug industry middlemen.
In a complaint filed in Washington County Superior Court, Attorney General Charity Clark, a Democrat, said that CVS Health's CVS.N Caremark, Cigna Group's CI.N Express Scripts and some of their affiliates pushed patients toward more expensive drugs even when cheaper ones were available, and pocketed the extra cost through an opaque system of fees.
That violates a Vermont consumer protection law, Clark alleged. She is seeking a court order ending the allegedly illegal practices, and an unspecified amount of damages.
CVS spokesperson Mike DeAngelis said in an email that PBMs bring down prices by negotiating with drugmakers, and do not determine what prices are charged by manufacturers. He said the company intended "to vigorously defend against this baseless suit."
Caremark, Express Scripts and UnitedHealth Group's UNH.N OptumRx together make up about 80% of the pharmacy benefit manager (PBM) market.
PBMs negotiate with drugmakers, health insurance plans and pharmacies to set prescription drug prices and decide which drugs will be included on their so-called formularies — lists of drugs covered by insurance.
They have recently come under increasing scrutiny, with the U.S. Federal Trade Commission expected to sue the three major players for their role in negotiating insulin prices. DeAngelis said that PBMs have in fact helped reduce those prices.
Other states that have brought lawsuits over PBMs' business practices include Hawaii, California, Ohio and Kentucky.
The case is State of Vermont v. Evernorth Health Inc, Superior Court, Washington Unit, case number not yet available.
