Metalloinvest to take legal action over confiscation of its iron ore in Ukraine

MOSCOW, Aug 19 (Reuters) -Russian-based iron ore producer Metalloinvest will take legal action against Ukraine and any potential buyer if Kyiv confiscates tens of millions of dollars worth of the company's iron ore it seized in 2022, two sources told Reuters.
A Ukrainian court is due to hear on Sept. 19 a lawsuit filed by the country's justice ministry in July seeking to confiscate the assets of shareholders of Metalloinvest majority owner USM Holding located on Ukrainian territory.
Ukrainian authorities confirmed in December 2022 the seizure of around 160,000 metric tons of Metalloinvest's iron ore, nine months after Russia sent thousands of its troops into the country.
Ukraine's security service, the SBU, said the ore was of Ukrainian origin and was kept in illegal storage in the country's ports and was destined for Russia.
Its Economic Security Bureau said that Metalloinvest was trying to ship the ore to Ukrainian-based firms to evade paying Ukrainian value-added tax.
Metalloinvest denies all the allegations by Ukrainian authorities.
It says that the ore was produced in Russia and was shipped through Ukraine to international buyers just before February 24, 2022, the day the war in Ukraine started, when it was seized by Ukrainian authorities, some in ports and some still on the railway.
Documents seen by Reuters show that the shipping route through Ukraine was used by the company to send iron ore to markets in Europe and Asia before the war.
Both sources close to the company said that Metalloinvest intended to defend its rights both in Ukrainian courts and internationally, including through legal action against Ukraine. One of the sources said any potential buyer of the ore would face legal action.
A spokesperson for Metalloinvest declined to comment.
Ukraine's justice ministry told Reuters it would not comment on Metalloinvest's reported legal plans.
Ukraine's Supreme Anti-Corruption Court hearing in September will rule on the fate of the ore. If the justice ministry wins its case, the planned challenge by Metalloinvest would be the first major international legal action against a confiscation ruling by the court.
If the ore is confiscated, it would most likely be sold to either domestic or international buyers. The court has since 2022 confiscated assets linked to several Russian businessmen and officials, including billionaire Vladimir Yevtushenkov, a founder of the Sistema telecoms-to-agriculture conglomerate.
Yevtushenkov has publicly said that he no longer has any assets in Ukraine.
Russian billionaire Alisher Usmanov used to control USM but has gradually reduced his share to below 50%.
